Introduction

These Terms of Use ("Terms") govern your use of the Galbit mobile application (the "App") and any related services provided by Galbit ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Eligibility

By using the App, you represent and warrant that:

You are at least 13 years of age (or the minimum age in your jurisdiction)
You have the full power and authority to enter into these Terms
You are not located in a country that is subject to a U.S. government embargo
You will comply with all applicable laws and regulations

2. Account Registration

2.1 Account Types

The App offers two types of accounts:

Permanent Account: Created with email/password or Apple Sign-In
Guest Account: Temporary account with auto-generated credentials that can be upgraded to a permanent account

2.2 Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

Provide accurate and complete information
Promptly update any changes to your information
Notify us immediately at support@galbit.app of any unauthorized use
Use strong passwords and maintain proper security

We are not liable for any loss or damage arising from unauthorized use of your account.

2.3 Apple Sign-In

If you sign in with Apple, you acknowledge that:

Your email address may be hidden based on your Apple privacy settings
Your email cannot be changed through the App (managed by Apple)
Apple User ID is used to link your account for authentication

3. Subscription and Payments

3.1 Subscription Services

The App may offer subscription-based premium features. Subscriptions are managed through Adapty, our third-party subscription management service. By purchasing a subscription, you agree to:

Pay all applicable fees as described in the App
Provide accurate payment information
Authorize us to charge your payment method

3.2 Auto-Renewal and Cancellation

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your account settings on the App Store or Google Play Store. No refunds are provided for partial subscription periods.

3.3 Price Changes

We reserve the right to modify subscription fees with reasonable advance notice. Continued use of the App after price changes constitutes acceptance of the new fees.

4. User Data and Content

4.1 Your Data

You retain all ownership rights to the data you create in the App, including:

Habit information and tracking data
Goals and milestones
Personal notes and entries
Profile information and preferences

4.2 License to Use Your Data

By using the App, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and process your data solely for the purpose of providing and improving the App's services, as described in our Privacy Policy.

4.3 Data Deletion

You can delete your account and associated data through the "Delete Account" feature in the App's Edit Profile section. Guest account data may be deleted if not converted to a permanent account within a reasonable period.

5. Acceptable Use

You agree not to:

Use the App for any illegal purposes
Harass, abuse, or harm other users
Impersonate any person or entity
Interfere with the proper functioning of the App
Attempt to gain unauthorized access to our systems
Reverse engineer or decompile the App
Use automated means to access the App
Transmit any viruses or malicious code

6. AI-Powered Features

The App uses AI technology to provide personalized habit suggestions. By using these features, you acknowledge that:

AI suggestions are generated based on your onboarding responses
Your onboarding data is processed by OpenAI (our AI service provider)
AI suggestions are for informational purposes only and not professional advice
You can choose not to use AI-generated suggestions during onboarding

7. Intellectual Property Rights

7.1 Our IP

The Galbit App, including its original content, features, functionality, trademarks, service marks, logos, and design elements, is owned by us and protected by international copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or create derivative works of the App
Use our trademarks without written permission
Remove any copyright or proprietary notices

7.2 Feedback

If you provide us with suggestions, feedback, or ideas for improving the App, you grant us the right to use them without compensation or restriction.

8. Third-Party Services

The App integrates with third-party services, including:

Adapty: Subscription management
Apple Sign-In: Authentication
OpenAI: AI-powered habit suggestions
Brevo: Email verification services
MongoDB Atlas: Database hosting
Render.com: Backend hosting

These services have their own terms of use and privacy policies. We are not responsible for their practices.

9. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including:

Breach of these Terms
Violation of applicable laws
Fraudulent or harmful activities
Extended inactivity
At your request (account deletion)

Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions and limitations of liability.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

IMPLIED WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY OF CONTENT
UNINTERRUPTED OR ERROR-FREE SERVICE

We do not guarantee that the App will meet your requirements or that any habits tracked will lead to specific outcomes.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GALBIT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the App
Any unauthorized access to or use of our servers
Any interruption or cessation of transmission
Any bugs, viruses, or malicious code
Any conduct or content of any third party

Our total liability shall not exceed the amount you paid us, if any, during the twelve months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Galbit and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Your content or data in the App

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in [Your City/State], unless otherwise agreed. Each party shall bear its own costs.

13.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class actions.

14. Changes to Terms

Sending an in-app notification for significant changes

Your continued use of the App after such changes constitutes acceptance of the modified Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Galbit regarding the App.

15.2 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
